Consumer Privacy Rights
Beach Cities Orthopedics & Sports Medicine and Beach Cities Orthopedics Surgery Center, LLC (BCO) are deeply committed to supporting compliance with the California Privacy Rights Act (CPRA) and other applicable U.S. consumer privacy laws. BCO has implemented a U.S.-focused privacy program to accommodate the fast-growing need for a consistent approach to data privacy in the U.S. Our U.S. Privacy Program creates a set of privacy standards across our products and services processing U.S. data, aimed at assisting you in light of our obligations under applicable privacy law.
As of January 1, 2023, BCO commits to the following privacy protections for all Consumers:
Definitions: “Client Personal Data” means all personal information (as defined in the CPRA) that BCO processes in connection with providing services to Client.
BCO Obligations: BCO, as a Data Processor (or equivalent term under Applicable Law), will comply with Applicable Law for Processing Client Personal Data pursuant to the Agreement. BCO will not: (a) “sell” or “share” Client Personal Data; (b) retain, use, disclose or otherwise Process Client Personal Data outside of its direct business relationship with Client or for any commercial or other purpose other than the business purposes specified in the agreement(s) between Client and BCO, except as permitted by Applicable Laws; or (c) combine Client Personal Data with personal data that BCO receives from, or on behalf of, other persons, or collects from its own interaction with a consumer, except as permitted under Applicable Law.
Transfers to Subcontractors: BCO may transfer Client Personal Data to BCO Subcontractors and Third-Party Subcontractors located outside of the country in which Client Personal Data was collected. Third Party Subcontractors are bound by written contracts with BCO that impose data protection terms that are no less protective than those imposed by this Data Privacy Appendix. An up-to-date list of BCO’s Subcontractors and Third-Party Subcontractors is available upon request; such a list may be updated from time to time.
Compliance Obligations: BCO will notify Consumers if BCO makes a determination that it can no longer meet its obligations under Applicable Laws. Consumers may, upon providing written notice to BCO, take reasonable steps to stop and remediate unauthorized processing of Personal Data.
De-identification and Aggregation: In addition to any rights granted to BCO to use aggregated and anonymized data, BCO will not attempt to, and will not, re-identify any Personal Data.
Protecting the privacy and security of your data is at the heart of BCO´s mission. As part of our commitment to keeping your data confidential, we want to reinforce the significant measures in place to protect the personal data you send to BCO.
Individual Rights Requests: BCO will provide support to handle requests from consumers, teammates, or regulatory authorities to help with those matters.
Audit Rights: BCO will also provide support in the event you seek information on our data privacy or security compliance activities.
BCO has a Privacy team that drives privacy efforts across our entire business. The team is responsible for designing and implementing enterprise-wide compliance programs, and includes a Privacy Officer, lawyers, and privacy professionals. Our team is responsible for updating and supervising BCO’s security program. All BCO employees, including contingent workers, receive regular privacy and security training and are bound by our Business Code of Conduct to maintain the confidentiality of all the data they handle.
